When tips fall short
If a worker's cash wage plus reported tips do not average to the Missouri minimum of $13.75 per hour over a workweek, the employer must pay the shortfall. Under the 2021 DOL final rule, time spent on non-tip-producing work above 20 percent of the shift (or 30 continuous minutes) must be paid at the full minimum, not the tip-credited rate. [DOL FS-15]
Background
Proposition A (2024) sets the rate to $13.75 on 2026-01-01 and $15.00 on 2027-01-01, then CPI-W indexing. Tipped cash wage is half the state minimum per RSMo section 290.502. The earned-sick-time provision of Prop A was repealed by HB 567 (2025) but the wage schedule survived.
